On Its Face, the SpaceX Immunity Statute Does Not Apply to Starbase Louisiana
La. R.S. 9:2800.31, the SpaceX Immunity Statute, insulates “aerospace flight entities” from liability for infringing on Louisiana property rights. “Aerospace flight entities are broadly defined. However, the protection from liability for property damage is limited by Section B of the statute to an “aerospace flight entity that owns and operates a minimum of twenty thousand contiguous acres in this state…” According to the Vermilion Parish public records, as of August 25th, 2026, SpaceX does not own the 125,000-plus acres that will become Starbase Louisiana. Rather, that property is owned by the Industrial Development Board of Vermilion Parish, Inc. (“IDB”). Therefore, SpaceX cannot invoke immunity under La. R.S. 9:2800.31 because it does not own twenty thousand contiguous acres.
